Terms of Use
The RidgeWarbler application (“Application”) is provided under these Terms of Use (“Terms”).
1. Purpose
These Terms define the conditions, procedures, rights, obligations, and responsibilities between RidgeWarbler (“Company”), which provides the Application, and the users of the Application (“User”).
2. App Store
If the Application is installed or used via Apple’s App Store or operating systems (e.g., iOS, iPadOS, watchOS, visionOS, tvOS), Apple’s Standard End User License Agreement (EULA) shall apply. In the event of a conflict between these Terms and the EULA, the EULA shall take precedence.
3. Conditions and Restrictions of Use
By accessing, using, uploading to, or downloading from the Application, the User agrees to comply with these Terms. The Company reserves the right to monitor the User’s activity to ensure compliance. If the User does not agree to these Terms, they are not permitted to use the Application.
3-1. Minimum Age Requirement
The Application is intended for users aged 13 or older, or the minimum legal age required to use the Application in their country of residence, whichever is higher. Minors who cannot enter legally binding agreements must have a parent or legal guardian review and accept these Terms. The parent or guardian assumes full responsibility for the minor’s use of the Application. The Company may restrict access to users under a certain age.
3-2. Service Availability
The Application is provided in South Korea and does not guarantee accessibility or appropriateness in other countries. Use of the Application may be restricted by law in certain jurisdictions, and use in such regions is prohibited. The Company may suspend or restrict access to the Application without prior notice if the User violates the Terms, engages in unlawful conduct, significantly impacts the operation of the Application, upon legal request, or due to technical or security issues.
4. Obligations
Users must not use the Application for illegal, commercial, or inappropriate purposes. Modification, editing, or redistribution of the Application without the Company’s approval is prohibited. Users are also responsible for any incidents resulting from their own negligence.
5. Changes to Terms and Application
The Company may amend these Terms when necessary. Any changes will be announced within the Application and on the website. For significant changes, the Company will notify Users at least 30 days in advance. If Users do not accept the amended Terms, they may discontinue use of the Application. The Company reserves the right to modify the Application, features, pricing, and programs, and is not liable for any consequences resulting from such changes.
6. Payment and Fees
6-1. Payment
If the Application is installed and used through Apple’s App Store, all payments are processed through the App Store. The Company does not collect or store payment information directly. Subscription and billing details can be managed through the User’s App Store account settings, and App Store billing policies apply. The Company does not handle issues related to payment methods or billing information.
6-2. Fees
Some features may require a paid subscription. Subscriptions are billed in advance and may include taxes. If pricing changes occur, the new rates will apply in the next billing cycle. The Company reserves the right to modify fees, taxes, or introduce new charges with reasonable prior notice.
7. Cancellations and Refunds
7-1. Auto-Renewal and Cancellation
Subscription fees are charged automatically at the beginning of each monthly or annual period and will continue until canceled by the User. Users will be notified of any price changes. To cancel a subscription made through the App Store, Users must cancel it through their App Store account. Cancellation takes effect at the end of the current billing period, and the Application remains accessible until then. After the subscription ends, features may be restricted. If resubscribed, the most current subscription fee at the time of renewal may apply.
7-2. Refunds
All payments and refund requests for purchases made through the App Store must be handled directly through Apple. The Company does not issue refunds. The App Store’s refund policy applies, and Users must contact Apple Support for such requests.
8. Promotions and Advertising
8-1. Free Trial
Subscriptions may begin with a free trial, which lasts for the period specified at signup. The trial may not be available with certain promotions and will be separately indicated. If Users do not wish to continue after the trial, they must cancel before the end of the trial period to avoid automatic billing. A temporary pre-authorization for a monthly subscription fee may occur, which may reduce available balance or credit limit. However, no actual charge will be made if the subscription is canceled before the trial ends.
9. Ownership and Intellectual Property
All rights to the RidgeWarbler Application, related software, in-app content, and materials belong exclusively to the Company. Users may not modify, distribute, sell, or create derivative works from the Application or its content without prior written consent. The Company grants Users a limited, personal, revocable, non-transferable, and non-sublicensable non-exclusive license to use the Application.
10. Dispute Resolution
In case of a dispute between the Company and the User, both parties shall make a good faith effort to resolve it amicably. Users must first contact the Company before initiating any legal action. Legal disputes arising from these Terms shall be subject to the jurisdiction of the courts under applicable civil procedure law. If the User resides in an EU member state, local mandatory laws may apply, and legal rights may be protected accordingly.
Supplementary Provisions
These Terms shall take effect as of March 24, 2025.
